Incompleteness of the land register? The judgment creditor of a property subject to registration is protected…. or not?

Legal news

The law explicitly includes that acquirers of rights to property subject to registration (purchasers for example) are protected from an incompleteness in the public registers (the land register). However, the section of law in question, Section 3:24 of the Dutch Civil Code, does not apply to judgment creditors of property subject to registration. Judgment creditors may derive third-party protection from Section 3:36 of the Dutch Civil Code, which provides a general rule of third-party protection and is not limited to the entry of property subject to registration. This follows from the ruling of the Dutch Supreme Court of 18 November 2016 (ECLI:NL:HR:2016:2640).
