Qualification of leased property, protection against eviction.
In these proceedings, the lessee (operator of a hockey canteen) requests conditional extension of the protection against eviction. Primarily, the lessee argued that it concerns business premises within the meaning of Section 290 of Book 7 of the Dutch Civil Code, meaning that it submits the request conditionally. Alternatively, the lessee requested extension of the eviction period. With reference to other proceedings (under number 557500 CV EXPL 12-6322, LJN BY3228) the subdistrict court rules that it concerns the lease of Section 290 business premises.
