Both the lessor and the lessee are confronted with an obligation to deliver the leased property, be it at different times. In principle, for the lessor this is upon the start of the term of the lease and for the lessee upon the end of that term. The scope of this delivery obligation is not always easy to determine, since it is determined by both the parties’ mutual arrangements and the statutory framework. Below, the lessor’s delivery obligation upon the start of the lease (paragraph 2) will first be dealt with, followed by the lessee’s delivery obligation upon the end of the lease (paragraph 3).
